PRIVACY POLICY PURSUANT TO ARTICLES 13 – 14 OF EU REGULATION NO. 679/2016 (GDPR)

 

Who is the Data Controller for your personal data?

The Data Controller for the processing of the personal data collected through this website is New Time S.p.A., with main offices in Via Campo dei Fiori 4, 47122 Forlì, FC, Italy; VAT number: 03700900404 (hereinafter also the 'Data Controller’). An updated list of external processors and sub-processors is available at the premises of the Data Controller. Pursuant to articles 3 and 27 of the EU Regulation no. 679/2016, we hereby inform you that the Data Controller has appointed Consulenti Privacy S.r.l. as Data Protection Officer (DPO). Why do we process your personal data and when do we collect them?

While browsing our website we collect personal data from you (hereinafter also 'Navigation Data'), for example the IP address of your PCs, the domain names of your computers and terminals, the URIs/URLs (Uniform Resource Identifiers/Locators) of the resources requested, the time of the request, the method used to submit the query to the server, the size of the reply file, the numerical code indicating the status of the reply provided by the server (successful, error, etc.) and other parameters related to your operating system and IT system. Our website also features a section entitled 'REQUEST A FREE, NON-BINDING CONSULTATION', which you can use to schedule an appointment with our staff to obtain a quote for our products and download our 'handbook’ – i.e. a PDF document presenting our products which is not price list. If you decide to write to us, we will also process your personal and contact details such as your name, surname, telephone number, province of origin, and e-mail address (hereinafter 'Service-related Data').

What are we entitled to do by law?

In accordance with the EU Regulation no. 2016/679 (GDPR) we are allowed to process the various types of data for the following purposes. 

Navigation data Navigation data are needed for statistical purposes, to improve our website, and to protect your safety while browsing. These data do not enable us to identify you. We will process such data on the basis of our legitimate interest and that of the user (art. 6 (f) of the GDPR). 
Navigation data (cookies) We also collect data for the purpose of analysing and processing information about you, your preferences, habits, consumption choices and/or browsing experiences. We analyse and process such information through the use of technologies such as cookies – our own cookies or third-party cookies. The data are collected through the use of cookies only after your express consent (art. 6 (a) of the GDPR). You will be informed in this respect through a dedicated banner located at the bottom of the website when you log on for the first time. For more information, please read our Cookie policy.
'Request a free, non-binding consultation' (Service-related Data) We process your contact data such as your first name, last name, telephone number, and e-mail address so to be able to process your free, non-binding consultation request. In accordance with the GDPR we are allowed to process these data without your consent as that is necessary for the execution of pre-contractual measures (art. 6 (b) of the GDPR). You can always decide not to provide us with your data, but you will not be able to send us any requests for consultation. In any case, your data will not be included in a mailing list for marketing purposes and will only be used for the purposes indicated above.

How do we process your personal data?

Your personal data are processed using appropriate tools and procedures to ensure their security and confidentiality. Processing may be carried out through our website and through other electronic devices – e.g. company databases – and sometimes through paper-based documents. In addition to the Data Controller, in some cases other parties involved in the organization of this Website – administrative staff, sales staff, system administrators, etc. – or external parties – such as third-party technical service providers, hosting providers, IT companies, communication agencies – appointed by us as Data Processors in the cases provided for by law may have access to the data. How long will we store your data for?

Navigation data: the data collected by the website while operating is stored for such time as is strictly necessary to execute the specific activities. Upon expiration, the data will be erased or anonymised, unless they are to be retained longer for other purposes. The Data processor has no control over cookies entirely set by third parties and has no access to the information collected by such cookies. Service-related data: the data will be stored for 36 months after the time of collection. If a product or service is purchased, then we will store your data for 10 years.

Where are your data located?

The processing of your Service-related personal data occurs within the European territory. We have chosen partners that allow us to keep data within the European Union, in accordance with the requirements of the Regulation. On the other hand, your browsing data (IP address) collected through the installation of cookies (for more information on cookies, please refer to our Cookie policy) may be transferred outside the European Union, and in particular to the United States (by way of example and not limited to, Google), whose level of data protection has been deemed adequate by the European Commission pursuant to art. 45 of the GDPR.

Who can access your personal data?

Your data may be made accessible to employees and collaborators of the Data Controller in their capacity as data processors and/or system administrators; to third-party companies or other entities (for example: professional firms, consultants, software houses that provide management systems, etc.) that perform outsourced activities on behalf of the Data Controller, in their capacity as external data processors.

 

The Data Controller may communicate your data to the Public Administration, Supervisory Bodies, and/or Judicial Authorities, as well as to all other parties to whom communication is mandatory or necessary by law. Your data will not be disclosed.

Your rights as data subject

As data subject, in the cases provided for by the law you have the right to obtain access to your personal data and to obtain the rectification or erasure of such data or the restriction of processing concerning you, or to object to the processing (art. 15 et seq. of the Regulation). Right to lodge a complaint

If you believe that the processing of your data breaches the GDPR provisions you will have the right to lodge a complaint with the Italian Data Protection Authority as provided for by art. 77 of the GDPR, or to take appropriate legal action pursuant to art. 79 of the Regulation.

Protection of children's privacy

This website is targeted to a general audience. However, its services are addressed to people aged 18 or older. We do not solicit, collect, use, or disclose any personal data provided online by persons under the age of 18. Should we discover that we have collected data from a person under legal age, we will delete such data immediately.
